Terms of Service

1. Who these terms apply to
These User Terms are an agreement between you and Caremate Health Inc. (“Caremate”, “we”, “us”). They apply to you as an individual when you access the Caremate service (the “Service”) through an account provided by the pharmacy, hospital, health authority, or other organization that subscribes to the Service (your “Organization”).
Your Organization has a separate agreement with Caremate that governs the Service itself — what it includes, what it costs, and how patient information is handled. These User Terms do not change that agreement. Nothing you accept here creates any obligation for your Organization, and accepting these User Terms does not amend your Organization’s agreement in any way. These User Terms cover only your own access to and use of the Service.
If you do not agree to these User Terms, do not use the Service.
2. Your account
Your Organization provides and controls your access to the Service. You must:
• keep your login credentials confidential and not share them with anyone, including colleagues; use only the account assigned to you, and not access the Service through anyone else’s account; tell Caremate at security *_at_* caremate.ai and tell your Organization promptly if you believe your credentials have been lost or stolen, or that someone else has used your account.
You are responsible for activity carried out under your account.
3. Patient consent
Before starting a recording, you must obtain informed consent from the patient and from anyone else present during the consultation, such as a family member or caregiver. Your Organization is responsible for its patient consent process; you are responsible for following it on every recording.
Do not use the Service to record or transcribe any interaction for which consent has not been obtained, or for which consent has been withdrawn.
4. Professional responsibility
The Service assists with clinical documentation. It does not provide clinical advice and does not replace your professional judgment.
Notes, classifications, and analyses produced by the Service are drafts. You are responsible for reviewing each note for accuracy and completeness, correcting any errors, and approving it before it is relied on, exported, or entered into a patient record. Approving a note is your professional act.
5. Acceptable use
You will use the Service only for the purposes your Organization has authorized, and only in your professional capacity. You will not:
• use the Service for any purpose other than delivering and documenting patient care; record, upload, or enter content that is unrelated to a clinical interaction; copy, modify, translate, reverse engineer, decompile, or attempt to derive the source code, models, or underlying structure of the Service; circumvent or attempt to circumvent any security control, access restriction, or usage limit; use automated means to access or extract data from the Service; resell, sublicense, or give access to the Service to any other person; use the Service in a way that breaches applicable law, your professional obligations, or your Organization’s policies.
6. Privacy
How Caremate handles personal and health information is described in the Caremate Privacy Policy, at https://www.caremate.ai/legal/privacy .
Your Organization is the custodian of the patient information you record through the Service and controls that information. As between Caremate and your Organization, the handling of that information is governed by the agreement between them.
7. Access and suspension
Your access to the Service is conditional on your acceptance of these User Terms. If you decline them, your access will end and Caremate will notify your Organization.
Caremate may suspend or end your access if you breach these User Terms, if your Organization’s subscription ends, or if your Organization asks Caremate to remove your access.
8. Changes to these terms
Caremate may update these User Terms. When we do, the updated version will be presented to you the next time you sign in, and you may accept it or decline it. Declining ends your access to the Service. The current version is always available at https://www.caremate.ai/legal/user-terms .
